These Terms of Use (the "Terms") are an agreement between you and Osmi Health, Inc. ("Osmi", "we", "us"), operator of the Osmi app, website, and quiz (together, the "Service"). Osmi Health, Inc. is a Delaware corporation registered at 131 Continental Dr, Ste 305, Newark, DE 19713, United States. By accessing or using the Service, you agree to these Terms. If you do not agree, please stop using the Service.
Osmi is a wellness tool, not medical care
Osmi helps you understand how you feel and offers general, natural, everyday suggestions to support your wellbeing. Osmi does not provide medical advice and is not a substitute for a doctor. It does not diagnose, treat, cure, or prevent any condition, and it will never ask you to start, stop, or change any medication. Always talk to a licensed healthcare professional about medical concerns, and never disregard professional advice because of something you read in the Service. If you think you may have a medical emergency, contact your doctor or emergency services immediately.
1. Eligibility
You must be at least 18 years old to use the Service. By using the Service you confirm that you meet this requirement and that the information you provide is accurate.
2. The Service
Osmi lets you take a quiz about how you feel, scan foods and products, and receive general daily support and cleaner-swap suggestions personalized to your answers. The content is provided for informational and wellness purposes only, and we do not guarantee that any information in the Service is complete, accurate, or up to date.
3. Accounts
The current iOS app does not require an account.
4. Subscriptions, billing, and automatic renewal
Subscriptions purchased in the iOS app are billed by Apple through App Store In-App Purchase. The app shows the price, billing period, and trial terms before purchase. The subscription renews automatically unless you cancel it through Apple Account subscription settings.
5. Cancellation
To cancel an iOS-app subscription, open Apple Account subscription settings. Cancellation turns off renewal. Access continues until the end of the current paid period.
6. 30-day money-back guarantee
If Osmi is not right for you, contact us at hello@osmihealth.co within 30 days of your purchase and we will provide a full refund of that purchase. This guarantee is offered in addition to any rights you may have under applicable consumer law. For an App Store purchase, request a refund from Apple at reportaproblem.apple.com. Apple decides eligibility and processes approved refunds.
7. Acceptable use
You agree to use the Service only for your own personal, lawful use. You may not copy, resell, or redistribute the Service or its content; interfere with or disrupt the Service; use bots or automated systems to access it; or attempt to circumvent its security or usage limits.
8. Intellectual property
The Service and all of its content, software, text, graphics, and the Osmi name and logo are owned by Osmi or its licensors and are protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable licence to use the Service for personal use. We reserve all rights not expressly granted.
9. Your submissions
If you submit content to us (such as feedback or a review), you grant Osmi a worldwide, royalty-free licence to use, display, and reproduce that content in connection with the Service. You are responsible for what you submit and confirm you have the right to share it.
10. Disclaimers
The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or that any information or result obtained through it will be accurate or meet your expectations.
11. Limitation of liability
To the fullest extent permitted by law, Osmi will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or relating to your use of (or inability to use) the Service. Nothing in these Terms limits liability that cannot be limited under applicable law.
12. Changes to the Service and these Terms
We may modify or discontinue parts of the Service, and we may update these Terms from time to time. When we make material changes we will update the "Last updated" date above. Your continued use of the Service after changes take effect means you accept the updated Terms.
13. Governing law
These Terms are governed by the laws of the United Arab Emirates and, where applicable, the Emirate of Dubai, without regard to conflict-of-laws rules. Any disputes will be handled in the competent courts of Dubai, UAE, unless applicable law requires otherwise.
